1. Introduction

By downloading, accessing, or using the FateSpark application ("FateSpark", the "App"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree to these Terms, you must not use the App. By using the App, you represent and warrant that you are at least 18 years of age and are legally capable of entering into a binding agreement.

2. Entertainment Purposes Only

The App provides AI-generated astrological and related content for entertainment and informational purposes only. Nothing in the App constitutes or should be relied upon as professional, legal, medical, psychological, financial, or other professional advice. You are solely responsible for any decisions or actions you take based on the content provided by the App, and you should always seek the advice of a qualified professional where appropriate.

3. User Responsibilities

You agree to use the App only for lawful purposes and in accordance with these Terms. The App is intended for adults only, and by using the App you attest that you are at least 18 years of age. You must not allow any person under the age of 18 to access or use the App using your device or account.

If you choose to provide birth chart information or other personal data, you agree that such information will be accurate and complete. You understand and acknowledge that all responses and outputs are generated by artificial intelligence and may be incorrect, incomplete, or not suited to your personal circumstances.

4. Intellectual Property

All rights, title, and interest in and to FateSpark and the App, including but not limited to all software, code, features, functionality, text, graphics, images, logos, designs, layouts, and any other materials or content provided through the App (collectively, the "App Content"), are owned by the App, its creators, developers, owners, or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App and App Content for your personal, non-commercial use only. You must not, and must not allow any third party to:

• copy, reproduce, modify, adapt, translate, distribute, transmit, display, perform, publish, or create derivative works from the App or App Content;
• sell, resell, license, sublicense, rent, lease, or otherwise commercially exploit the App or App Content;
• reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the App; or
• remove, alter, or obscure any copyright, trademark, or other proprietary notices.

Any unauthorized use of the App or App Content is strictly prohibited and may result in termination of your access to the App and may violate applicable laws.

5. Limitation of Liability

To the fullest extent permitted by applicable law, FateSpark and its creators, developers, owners, employees, officers, directors, contractors, licensors, partners, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including without limitation loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with:

• your access to, use of, or inability to use the App;
• any conduct or content of any third party on or through the App; or
• any content obtained from the App.

To the extent any liability cannot be excluded under applicable law, our aggregate liability to you arising out of or relating to the App or these Terms shall be limited to the amount (if any) you paid to use the App during the six (6) months immediately preceding the event giving rise to the claim.

6. Indemnification and Hold Harmless

You agree to indemnify, defend, and hold harmless FateSpark, the App, its creators, developers, owners, employees, officers, directors, contractors, licensors, partners, affiliates, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, proceedings, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• your access to or use of the App;
• your breach or alleged breach of these Terms; or
• your violation of any law or the rights of any third party in connection with your use of the App.

This indemnification obligation will survive your use of the App and any termination of these Terms.

7. Modifications to the App and Terms

We reserve the right, at any time and in our sole discretion, to modify, suspend, or discontinue the App (in whole or in part) with or without notice. We also reserve the right to modify these Terms at any time. When we do so, we will update the "Last Updated" date at the top of these Terms. Your continued use of the App after any changes to the App or these Terms constitutes your acceptance of those changes.

8. Governing Law and Dispute Resolution

These Terms and any dispute, claim, or controversy arising out of or relating to the App or these Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. You agree that the state and federal courts located in Saint Lucie County, Florida shall have exclusive jurisdiction over any such dispute, and you hereby consent to the personal jurisdiction and venue of such courts.
